Fleming Commonwealth’s Attorney Kathryn Hendrickson announced the arrest of James Donovan, 26, of Flemingsburg, in Fleming County, on five counts of distribution of child pornography, four counts of possession of child pornography, and tampering with physical evidence, all Class D felonies that carry a penalty of 1-5 years imprisonment.
The arrest warrant is the result of an investigation by Attorney General Jack Conway's Department of Criminal Investigation, Cyber Crimes Unit.
After identifying a Fleming County computer IP address that was actively possessing and trading suspected child pornography, DCI obtained and executed a search warrant on Donovan's residence.
Donovan allegedly attempted to destroy the digital data on his computer after learning that an official investigation involving his computer was ongoing.
The Fleming County Sheriff's office arrested Donovan Wednesday, June 3.
Donovan posted $1,000, or 10 percent of his $10,000 bond. He is prohibited from use of any computers or being around anyone under the age of 18. He is scheduled for arraignment before the Fleming Circuit Court on June 17.
A charge is merely an accusation and a defendant is presumed innocent until and unless proven guilty.
