30 indicted by grand jury

July 24, 2012 — Allen Lee Denney, 21, was indicted by a Rowan County grand jury for rape when he allegedly had sex with someone under the age of 16 in March.

Twenty-nine other people were indicted on charges including assault, theft by unlawful taking and marijuana cultivation.

Also indicted were:

• Roger D. Haney, 61, for assault when he allegedly fought with Officer Jeremy Cauley on May 28.  Haney also was indicted for operating a motor vehicle under the influence, disorderly conduct and resisting arrest. 

• Ervin Kegley Jr., 34, for criminal possession of a forged instrument when he allegedly tried to cash a forged $80 check from Ervin Kegley and Patricia Kegley at Johnson’s Grocery in Rowan County on March 5.

• Phillip Michael Roar, 34, for theft by unlawful taking – shoplifting when he allegedly took a $514 laptop computer from Aaron’s in Morehead on Feb. 20.

• Willie Dale Shearer, 48, for flagrant nonsupport when he allegedly did not pay $21,470.17 in child support from Mar. 23, 2007 through June 8, 2012.

• Kathy Townsend, 42, for theft by unlawful taking when she allegedly took $3858.53 in cash from her drawer while working at the Cashier’s Office of Morehead State University between Aug. 19, 2011 and May 25, 2012.

• Michael J. Bowman, 48, for marijuana cultivation when he allegedly planted, cultivated or harvested 63 marijuana plants with the intent to sell or transfer on May 31. 

• Kristina L. Cornett, 21, for burglary when she allegedly took a Winchester 30-300 Lever Action Rifle into Stanley R. Ingold’s residence at 880 Moores Flat Road with intent to commit a crime between Nov. 12, 2011 and Dec. 17, 2011. 

• Cassie J. Nelson, 33, for burglary when she allegedly took a Winchester 30-300 Lever Action Rifle into Stanley R. Ingold’s residence at 880 Moores Flat Road with intent to commit a crime between Nov. 12, 2011 and Dec. 17, 2011. 

• Joshua J. Brown, 31, for burglary when he allegedly took a Winchester 30-300 Lever Action Rifle into Stanley R. Ingold’s residence at 880 Moores Flat Road with intent to commit a crime between Nov. 12, 2011 and Dec. 17, 2011. 

• Travis R. Hamm, 28, for receiving stolen property when he allegedly had in his possession several of Marty Stevens’ stolen rifles, shotguns and revolvers on July 20.  Hamm also was indicted for possession of handgun by convicted felon and possession of a firearm by convicted felon.

• Michael Stevens, 36, for receiving stolen property when he allegedly possessed a stolen firearm between June 4 and June 20.

• Sherry R. Oney (also known as Sherry Dummitt), 45, for criminal possession of a forged instrument when she allegedly tried to cash a $126 forged check from Danny Mullins at FastLane in Morehead on Oct. 25, 2011.  Oney also was indicted for criminal possession of a forged instrument when she allegedly cashed a $120 check from Danny Mullins on Nov. 8, 2011.

• Larry David Barker, 31, for two counts of criminal possession of a forged instrument when he allegedly tried to cash $400 worth of checks from James M. and Angela J. Allen at Whitaker Bank in Morehead on June 18.  Barker also was indicted for theft by unlawful taking when he allegedly took a check book of blank checks that belonged to James M. and Angela J. Allen.

• Ashley Leann Brown, 29, for forgery when she allegedly passed a $200 forged check from James M. and Angela J. Allen, knowing the check was forged, on June 18.  Brown also was indicted for Forgery when she allegedly passed a $200 forged check from James M. and Angela J. Allen, knowing the check was forged. 

• Larry Duane Flannery, 44, for possession of matter portraying a sexual performance by a minor when he allegedly had matter that visually depicted a sexual performance by a minor between Jan. 27 and June 5. 

• Stephen Allen Townsend, 49, and Kimberly Renee Fultz, 40, for marijuana cultivation when they allegedly planted, cultivated or harvested five or more marijuana plants with the intent to sell or transfer on June 11.  Townsend and Fultz also were indicted for possession of drug paraphernalia, possession of a controlled substance not in original container.

• Brian L. Killen, 32, for manufacturing methamphetamine when he allegedly had in his possession 10 tablets of pseudoephedrine, three bottles of iodine, Coleman fuel and a bottle of Heet with intent to use the items for making meth on June 18. Killen also was indicted for wanton endangerment when he allegedly manufactured meth in a mobile home with a six-year-old child present. Killen was indicted for tampering with physical evidence when he allegedly poured the bottle of Coleman fuel down the toilet.

• Melissa D. Fultz, 34, was indicted for complicity to manufacturing methamphetamine when she allegedly assisted Brian Killen by allowing him to make meth in her home on June 1.  Fultz also was indicted for wanton endangerment when she allegedly allowed others to manufacture meth in her apartment while her six-year-old daughter was home.

• David W. Murphy (a/k/a “Smurf”), 32, for assault – domestic violence when he allegedly choked Kathy Donathan, causing minor physical injuries. Murphy also was indicted for wanton endangerment when he pointed a handgun at Donathan.  Murphy was indicted for terroristic threatening when he allegedly threatened to kill Donathan with a .22 caliber handgun.

• David “Smurf” Murphy, 32, for criminal attempt of burglary when he allegedly tried to commit a crime at Rowan Water.  Murphy also was indicted for criminal mischief when he allegedly caused $1,000 worth of damage to the rear door of the building.  He was indicted for theft by unlawful taking, farm equipment, over $500 and less than $10,000 when he allegedly took a 1980 Ford Farm tractor worth $7,800 from Rowan Water on June 13.

• Stephen C. Thompson, 25, for receiving stolen property when he allegedly pawned a viola belonging to McBrayer Elementary School valued at $975.  Thompson also was indicted for receiving stolen property when he allegedly pawned a $50 Magellan GPS unit belonging to Regina Morrow between Nov. 28, 2011 and Jan. 18, 2012.

• Leonard Trent, 72, for criminal attempt of murder when he allegedly threatened and planned to kill Tonya and Michael Potter on May 20. 

 

• Roberty M. Shenett, 44, for receiving stolen property when he allegedly had a $675 5000 watt generator belonging to Diane Bowling on May 27.  

• David Michael Cline, 42, for theft by unlawful taking, automobile, when he allegedly took a $15,000 camper belonging to Cynthia R. Benton from a storage area at White’s Mobile Home Park in Rowan County on May 26 and May 27.

• Mark O. Cline, 24, for Theft by Unlawful Taking, Automobile, when he allegedly took a $15,000 camper belonging to Cynthia R. Benton from a storage area at White’s Mobile Home Park in Rowan County on May 26 and May 27.

• Ronald D. Barker, 42, for theft by unlawful taking, farm equipment, over $10,000 when he allegedly took a 2000 Ford tractor, disc plow, bush hog, aluminum carport and aluminum building from the property of Martha S. Fulton of 1965 Bluestone Road in Morehead, valued at $16,000 between Jan. 10, 2010 and Oct. 11, 2011.  

• Carolyn A. Barker, 38, for theft by unlawful taking, farm equipment, over $10,000 when she allegedly took a 2000 Ford tractor, disc plow, bush hog, aluminum carport and aluminum building from the property of Martha S. Fulton of 1965 Bluestone Road in Morehead, valued at $16,000 between Jan. 10, 2010 and Oct. 11, 2011. 

• Shawn B. Jones, 29, for second-degree burglary when he allegedly entered or remained unlawfully in the dwelling of Tyson Cloud. 

Jones also was indicted for arson when he allegedly started a fire with intent to destroy or damage a residence owned by Mike Nickell and occupied by Cloud, causing $4,000 worth of damage to Cloud’s personal property between July 9 and July 23, 2011.  Jones was indicted for tampering with physical evidence when he allegedly set a fire in the residence of Tyson Cloud to cover up a burglary.  Jones was indicted for theft by unlawful taking, over $500 and less than $10,000 when he allegedly took a flat screen TV, Wii Game System and A/C central air unit from the residence occupied by Cloud, valued at $2,000.

• Bobby A. Gambill, 30, for possession of a controlled substance when he allegedly had oxycodone, Schedule II, in his possession. Gambill also was indicted for possession of a controlled substance when he allegedly had Alprazolam and Clonazepam, Schedule IV, in his possession on June 25.

 

The indictment of a person by a grand jury is an accusation only, and that person is presumed innocent unless proven guilty.
